Terms of Service
Effective Date: September 15, 2026
The terms that govern access to and use of the AIccommodate platform.
1. Acceptance of Terms
By accessing or using AIccommodate ("the Service"), operated by AIccommodate LLC, a New York limited liability company ("AIccommodate," "we," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 18 years of age or be authorized by your school or employer to use the Service on their behalf. By using the Service, you represent that you meet these requirements.
Students and family members who use the student tools (the MetaCognAI AI Tutor and the Grammar Coach) or the family portal do so with a code issued by a teacher. They do not create accounts and are not parties to these Terms; their use is authorized and governed by the school's agreement with us and is described in our Privacy Policy.
These Terms should be read in conjunction with our Privacy Policy, which describes how we collect, use, and protect your information.
2. Description of Service
AIccommodate is an AI-powered educational accommodation platform designed for K-12 educators. The Service includes:
- 20+ AI-powered tools for transforming educational content into accommodated materials for students with IEPs, 504 plans, and varying learning needs
- A guided workflow for content analysis, clarifying questions, and tool recommendations
- Materials library for saving, retrieving, and exporting generated content
- Student and class data management with accommodation tracking
- AI Chat, a unified AI chat assistant (powered by the Atticus persona) for legal compliance guidance, educational research, UDL (Universal Design for Learning) support, and platform help
- MetaCognAI, a Socratic AI tutor portal for student use (teacher-controlled access)
- Grammar Coach, a student-facing writing-mechanics coach that uses the same teacher-issued codes and stores nothing
- A family portal where a parent or guardian can view a plain-language summary of their own child's supports, ask questions, and send the teacher a note (teacher-issued code, no account)
- Optional integrations with Canvas LMS, Google Classroom, and Google Drive
The Service is provided on an "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts & Registration
- You must provide accurate and complete information when creating an account.
- One account per person — sharing account credentials is not permitted.
- You are responsible for maintaining the security of your password and account. Use a strong, unique password and do not share it with others.
- You must notify us immediately at hello@aiccommodate.com (opens in a new tab) of any unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions & Billing
- Free Trial: New accounts receive a 14-day free trial with full access to all platform features. No credit card is required to start a trial.
- Subscription: After the trial period, continued access requires a paid subscription at $14.99 per month, except that the Grammar Coach remains available to teacher accounts after the trial ends, subject to daily usage limits.
- Payment Processing: All payments are processed securely by Stripe (opens in a new tab). We never see or store your full payment card details.
- Auto-Renewal: Subscriptions automatically renew each month on the anniversary of your subscription start date. You may cancel at any time.
- Cancellation: Upon cancellation, you retain access through the end of your current billing period. No refunds are issued for partial months.
- Price Changes: We reserve the right to modify subscription pricing with at least 30 days advance notice. Price changes will not affect your current billing period.
5. Acceptable Use
You agree NOT to:
- Use the Service for purposes other than legitimate educational activities
- Enter student data into the platform without proper authorization from your school or district
- Share your account credentials with others or allow unauthorized access to your account
- Attempt to access data belonging to other users
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in any way that could harm students or undermine their educational interests
- Attempt to circumvent security measures, rate limits, or access controls
- Use automated scripts, bots, or crawlers to access the Service
- Upload malicious content, malware, or any content that could compromise platform security
- Use AI-generated outputs without reviewing them for accuracy and appropriateness
- Misrepresent AI-generated content as your own professional assessment or clinical evaluation
We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.
6. Content & Ownership
Your Content
You retain all rights to the educational content you upload to the Service (lessons, worksheets, assignments, student data, class information). You grant AIccommodate a limited, non-exclusive license to process your content through our AI tools solely for the purpose of providing the Service to you. This license terminates when you delete your content or your account.
Our Content
AIccommodate retains all rights to the platform itself, including but not limited to: the user interface, application code, AI prompt designs, tool configurations, system architecture, and documentation. These are protected by copyright and other intellectual property laws.
Generated Content
AI-generated outputs (accommodated materials, graphic organizers, simplified texts, vocabulary resources, etc.) produced through the Service are yours to use for educational purposes. We do not claim ownership of content generated for you through the Service. However, similar outputs may be generated for other users who provide similar inputs, as AI-generated content is not exclusive.
7. AI-Generated Content
Important Notice
- AI-generated outputs are tools to assist educators, not replacements for professional judgment.
- You are responsible for reviewing all AI-generated materials before using them with students.
- AI may produce content that is inaccurate, incomplete, outdated, or inappropriate for your specific context.
- We do not guarantee the accuracy, appropriateness, grade-level suitability, or regulatory compliance of any AI-generated output.
- Legal and compliance information provided through AI Chat is informational only and does not constitute legal advice. Consult qualified legal professionals for legal decisions.
- Educational recommendations and UDL analyses are suggestions based on general research — they should be evaluated against your professional knowledge of your students.
- You assume full responsibility for how AI-generated materials are used in your educational setting.
8. Student Data & FERPA
Our handling of student data is described in detail in our Privacy Policy. Key points:
- We support FERPA compliance, but teachers and schools bear ultimate responsibility for ensuring proper authorization exists before entering student data into the platform.
- We recommend that schools establish Data Processing Agreements (DPAs) where required by institutional policy or applicable law.
- Our commitments regarding student data: no selling, no advertising use, no non-educational profiling, PII stripped from AI transmissions, data deleted on request, teacher-scoped access isolation.
- If we discover that student data has been entered without proper authorization, we will notify the responsible teacher and work to resolve the situation appropriately.
- The student tools and the family portal serve only what the school and teacher authorize: the family portal shows a parent only their own child's supports in plain language, and the platform never provides the student tools with a student's name or diagnosis.
9. Third-Party Integrations
Google API Services
AIccommodate's use and transfer to any other app of information received from Google APIs adheres to the Google API Services User Data Policy (opens in a new tab), including the Limited Use requirements. Your use of Google sign-in and Google integrations (Classroom, Drive) is also subject to the Google Terms of Service (opens in a new tab). For details on what Google data we access and how we handle it, see Section 2 of our Privacy Policy.
Optional Integrations
- Integrations with Canvas LMS, Google Classroom, and Google Drive are optional and require your explicit authorization via OAuth.
- We access only the data you authorize through these integrations.
- We are not responsible for the availability, accuracy, or data practices of third-party services.
- Your use of third-party services is governed by their respective terms of service and privacy policies.
- You may revoke integration access at any time through your account settings or the third-party service's settings (for Google: visit myaccount.google.com/permissions (opens in a new tab)).
- Revoking integration access may limit certain import/export features but will not affect core platform functionality.
10. Intellectual Property
- The AIccommodate platform, including all original content, features, functionality, and underlying technology, is owned by AIccommodate LLC and protected by copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of the platform without our prior written consent.
- The AIccommodate name, logo, and branding are our trademarks. You may not use them without permission.
- Feedback and suggestions you provide about the Service may be used by us to improve the platform without any obligation or compensation to you.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We specifically disclaim:
- Any warranty of merchantability, fitness for a particular purpose, or non-infringement
- Any guarantee of uninterrupted, timely, secure, or error-free service
- Any guarantee that AI-generated outputs will be accurate, complete, or suitable for your needs
- Any representation that the Service constitutes professional special education, legal, medical, or clinical advice
- Any warranty regarding the results obtained from use of the Service
Educational content recommendations, UDL analyses, accommodation suggestions, and compliance information are provided as informational tools and should not replace professional judgment or qualified professional consultation.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- AIccommodate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of AI-generated content.
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
- These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise).
- Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the minimum extent permitted by law.
- Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
13. Indemnification
You agree to indemnify, defend, and hold harmless AIccommodate, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Content you upload or create through the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your use of AI-generated content with students or in educational settings
- Your failure to obtain proper authorization for entering student data
14. Termination
- Either party may terminate the relationship at any time.
- You may cancel your subscription and delete your account through the platform or by contacting hello@aiccommodate.com (opens in a new tab).
- We may suspend or terminate your access immediately if you violate these Terms.
Upon Termination
- Your access to the Service will be revoked.
- You may request a data export within 30 days of termination.
- After 30 days, your data will be permanently deleted — subject to any applicable school data agreement and any records retained under those agreements and our written retention policies (such as the access-and-disclosure log we maintain to support schools' FERPA recordkeeping).
- Your subscription will be canceled and no further charges will be made.
Surviving Provisions
The following sections survive termination: Content & Ownership (Section 6), AI-Generated Content (Section 7), Disclaimers (Section 11), Limitation of Liability (Section 12), Indemnification (Section 13), and General Provisions (Section 16).
15. Changes to Terms
- We may modify these Terms from time to time.
- Updated Terms will be posted on this page with a revised effective date.
- We will provide at least 30 days notice for material changes via prominent notice on the platform.
- Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
- If you do not agree to the updated Terms, you should discontinue use of the Service.
16. General Provisions
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIccommodate regarding your use of the Service — except that any separately executed written agreement between AIccommodate and a school or district (including a Student Data Processing Agreement) controls over these Terms with respect to student data, to the extent of any conflict.
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
